Georgia K. McMillen, Esq., is a mediator, arbitrator and neutral specializing in the resolution of disputes throughout the State of Hawai’i. Legal counsel, their clients and other mediators consistently hold her in high regard for her knowledge of the law and subject matter of a case, as well as her ability to listen, keep everyone focused, and assist in building lasting agreements. As a mediator she is known for her skill in helping floundering parties articulate the problem and find solutions, her stamina during negotiations, her ability to provide realitychecks in difficult situations and her pursuit of settlement.
Her extensive training includes completion of the Advanced Mediation course at the Straus Institute for Dispute Resolution, Pepperdine Law School.
Ms. McMillen brings to every mediation and ADR case a 30-year litigation background that began in New York and New Jersey, and eventually brought her home to Hawai’i in 1998. As a civil litigator she has pursued some of the most complex environmental insurance cases in the country, as well as a many cases involving claims in the areas of: business and commercial law; debtor and creditor issues; employment; race and age discrimination; hostile workplace issues; construction law; divorce and family law; and insurance disputes. In criminal law she has defended clients in highly complex federal prosecutions involving death-penalty charges. She has argued numerous cases before the U.S. Court of Appeals for the Ninth Circuit, and coauthored the Ninth Circuit Appellate Practice Guide.
In her mediation and ADR practice Georgia K. McMillen has settled numerous cases in the following areas: business and commercial disputes; family law, divorce, child custody, division of assets; insurance disputes; employment; real estate, quiet title, foreclosure and condominium disputes; trusts and estates. In addition, she is an arbitrator for the Financial Industry Regulatory Authority, the largest independent regulator for all securities firms in the U.S. She is recognized by AVVO as one of the top mediators and neutrals in Hawai’i. Ms. McMillen is a former per diem judge for the Family and District Courts on Maui. She served on the faculty for the University of Hawai’i, teaching business law, and at Hawai’i Pacific University, teaching criminal law and procedure.
Ms. McMillen is committed to serving both the local community and the legal community. In the legal community, she sits on the board of directors for the Hawai’i State Bar Association (2015 2017). She is a former member of the board of directors for the Native Hawaiian Bar Association (2004-2014). From 2010-2013 she served as Appellate Lawyer Representative to the Ninth Circuit Judicial Conference. She is: a lifetime fellow of the American Bar Foundation; a member of the dispute resolution sections for both the American Bar Association and the Hawai’i State Bar Association; the Hawai’i Women Lawyers Association; the Maui County Bar Association; the Criminal Justice Act Panel for the U.S. District Court Hawai’i. As well, she regularly provides pro bono service to the Mediation Center of the Pacific and to the Hawai’i Supreme Court’s Center for Alternative Dispute Resolution. On Maui, she serves on the parish relations committee for Keawala’i Congregational Church.
Georgia K. McMillen was raised in Leeward O`ahu, graduating from the Kamehameha Schools (1975) and the University of Hawai’i (1978). She graduated with honors from New York Law School (1987), clerked for the Appellate Division, Superior Court of New Jersey, then began practicing law at Lowenstein Sandler in New Jersey and Ross & Hardies in New York (now McGuire Woods). In 1998 she returned home to Hawai’i and soon opened her own private practice. She is a resident of Maui where she lives with her husband, while maintaining offices in both Honolulu and Wailuku.
